UPDATES ON EMPLOYMENT ELIGIBILITY

Have You Accessed E-Verify Lately?  Effective August 1, 2016, the United States Citizenship and Immigration Service (“USCIS”) will deactivate E-Verify accounts that have not been accessed in 270 days.  To avoid losing your company’s E-Verify user identification credentials and account, ensure that someone from the company logs into E-Verify at least once every 270 days (approximately 9 months).  Simply logging in can save your company the headache of re-registering for E-Verify. 

The “Current” Form I-9:  Until further notice from USCIS, employers should continue using the Form I-9 bearing a March 31, 2016 expiration date.  Use of a then-current version of the Form I-9 on the date the form is completed is an important component of compliance with the Form I-9 process.  Although the current Form I-9 “expired” on March 31, 2016, USCIS has not yet issued a new version and has directed employers to continue using the outdated form until a new version is published.  This directive from USCIS that employers continue using a technically “expired” Form I-9 is a good reason to keep records of the effective dates for each version of the Form I-9 your company uses (which can differ from the official “expiration date” printed on the form) and maintain this information as part of your Form I-9 file.  Keeping track of when various versions of Form I-9 were in effect will help alleviate future confusion regarding whether or not the appropriate version of the form was used on any given date of hire.
