Vandeventer Black has continued to develop its bankruptcy and creditors’ rights practice in response to the changing economy. Our team has a broad range of experience in advising clients and negotiating on complex credit, bankruptcy and insolvency related matters.

Our attorneys have represented creditors of all sizes ranging from banks and international corporations to small businesses and individuals. In today’s economic and legal environment, insolvency laws affect virtually every commercial enterprise. Debtors whom our attorneys have successfully represented in Chapter 11 proceedings include large corporations and small businesses as well as individuals requiring debt restructuring assistance. We represent businesses, professionals, landowners and community associations in collection of past due accounts.

We represent businesses in pre-bankruptcy issues including foreclosure on collateral (including deeds and trusts), enforcement of judgments, evaluation of bankruptcy risks in various transactions (loans, leases and service and supply contracts), preparation of documents to minimize bankruptcy risks in commercial transactions, loan collateralization, and loan workouts and negotiation. Our post-bankruptcy experience includes relief from automatic stay, filing proofs of claim, enforcement of rights to cash collateral and adequate protection, enforcement and collection of administrative and post-petition claims, defense of preference claims, prosecution of dischargeability and discharge complaints, negotiation of bankruptcy plans of reorganization, and advice and representation with respect to commercial transactions with bankrupt parties (purchase of assets, establishing lending relationships).

In conjunction with our North Carolina offices, the Creditors’ Rights, Bankruptcy and Collections section practices in northeastern North Carolina as well as in Norfolk, Newport News, Richmond and Alexandria Bankruptcy Courts in the Eastern District of Virginia. Our attorneys are also qualified to practice in the Bankruptcy Courts in the Western District of Virginia.
