The number of bankruptcy filings is at an all-time high, making it imperative that contractors recognize their accompanying rights. Although it’s true that creditors usually are paid only a small fraction of what is owed them, exceptions do exist, and knowing your substantive rights and the process to enforce those rights is critical to maximizing recovery in bankruptcy.
